Abstract

The study aims to clarify the provisions of flagrante delicto in the new Saudi system of penal procedures and Egyptian law. The powers of the criminal investigation officer or the judicial officers were extended, and they were granted the power to carry out certain investigation procedures that affect the freedom of persons and the inviolability of their homes. Such powers are temporary and are not authorized in ordinary criminal investigation procedures. The study will clarify the concept of flagrante delicto, and its cases and conditions. Moreover, it will discuss the exceptional powers granted to the criminal investigation officer in cases of flagrante delicto in the Saudi legal system and Egyptian law.

The study yielded numerous recommendations, the most prominent are as follows: The implementation regulations of the Saudi system of penal procedures must clarify the concept of the criminal investigation officer more precisely, and must differentiate between the criminal investigation officer and the judicial officer presented by the Member of the Bureau of Investigation and Public Prosecution. It is of great importance that investigators submit all the observations they notice during cases of flagrante delicto, and they must provide appropriate suggestions to treat such cases and to achieve further development and justice.
