Abstract

This study aims to shed light on the most important guarantees and rights granted to the police employee in the fundamental system governing police personnel in Moroccan law. It highlighs the standards and determinants of disciplinary guarantees at all stages of the investigation and after imposing the punishment on the violating employee.To achieve the objectives of the study, the descriptive analytical approach was used.
The study has reached conclusions and suggestions, the most important of which is that the police employee must enjoy all the guarantees granted to them under the laws governing the disciplinary procedure, such as the obligation to investigate, confront the accused with the allegations against them, and enable them to defend themselves. . The guarantee of impartiality needs to be reconsidered, especially in view of the nature of the security job.
The study also emphasizes the need to develop systems and procedures for disciplinary investigation and trial, as well as to model disciplinary measures and align punishments with the offenses committed. This can be achieved by adopting a reference guide or charter to promote equality and protect employees from abuses of presidential authority, whether in good or bad faith. It is crucial to establish more transparent and effective guarantees and rules to ensure compliance with disciplinary regulations.
