The Legislative Confrontation of the Minors’ Harassment Crime Through Electronic Means

Abstract
This research addresses the issue of online harassment of minors, which is considered one of the most significant”silent” and covert crimes, often associated with a high”dark figure” of unreported cases. This type of crime has seen a marked increase in recent times, largely due to the growing dependence on modern technological tools across various aspects of life, the lack of adequate parental oversight and monitoring of children through technological means, as well as the decline in social and familial cohesion.
The situation becomes even more complex when a minor is subjected to such crimes and is unable to articulate her experience to her family or guardians.
The research culminates in a series of findings and recommendations, among the most notable of which is the observation that the Saudi regulator has addressed this type of crime under the Anti - Harassment Law. However, there are many difficulties in proving this crime, including the perpetrator’s ability to encrypt data stored through communication networks. The study recommended reconsidering the tightening of penalties in cases where two aggravating circumstances are combined—this is the situation the research aims to study. It also proposed imposing penalties on anyone who is aware of the occurrence of minor harassment and failing or neglects to report it.
